Part II contains a series of exemptions for different products.
2.3 These
Regulations do not apply to the handling, offering for transport
or transporting by any means of transport
(h) of
refrigerators or freezers that contain less than 12 kg of non-flammable,
non-poisonous liquefied compressed gas;
(i)
of dangerous goods contained in a means of transport where the
dangerous goods are necessary
(i) for
the operation of the means of transport, including spare parts
or stores,
(ii) for the safety of the means of transport, or
(iii) for the safety of the persons on board the means of
transport, if the dangerous goods are firmly secured, protected
from external damage or form an integral part of the means
of transport;
(j) of a
gas, other than a gas
(i) that
is radioactive,
(ii) that is corrosive, or
(iii) that is poisonous,
where the
gas is to be used for testing purposes and is contained in a
cylinder that
(iv) has
a water capacity not exceeding 1 L,
(v) is in compliance with the requirements of section 7.32,
SOR / 91-711
(vi) is filled to one-half or less of its gauge service pressure
at 55°C,
(vii) is packed to protect its valves and attachments, and
(viii) is contained in a packaging or a small container that
is marked to indicate
(A)
the shipping name of the gas,
(B) the classification of the gas, and
(C) the words "test gas exempt" or "gaz de
laboratoire - exempt";
2.3.3
(1) These Regulations do not apply to the handling, offering for
transport or transporting, by road or railway vehicle or by ship,
of diagnostic specimens or cultures that are reasonably believed
not to contain infectious substances that are included in risk
group II, III or IV of Division 2 of Class 6, in accordance with
the classification for risk groups set out in Part III or in the
tables set out in Schedule VII, if
(a) the
diagnostic specimens or cultures are contained in packaging
type 1B that meets the requirements of National Standard of
Canada CAN/CGSB-43.125-M90, Packaging of Infectious Substances
and Diagnostic Specimens, dated November 1990; or
(b) the diagnostic specimens are contained in a package that
is designed, constructed, filled and closed so that under normal
conditions of handling and transporting, there will be no discharge,
emission or escape of the diagnostic specimens from the package.
(2) Subject
to subsection (3), these Regulations do not apply to the handling,
offering for transport or transporting, by road or railway vehicle
or by ship, of diagnostic specimens or cultures that contain infectious
substances included in risk group II, in accordance with the classification
for risk groups set out in Part III or in the tables set out in
Schedule VII, if
(a) the
diagnostic specimens or cultures are contained in packaging
type 1B that meets the requirements of National Standard of
Canada CAN/CGSB-43.125-M90, Packaging of Infectious Substances
and Diagnostic Specimens, dated November 1990; or
(b) the diagnostic specimens are contained in a package that
is designed, constructed, filled and closed so that, under normal
conditions of handling and transporting, there will be no discharge,
emission or escape of the diagnostic specimens from the package.
2.4.2
These Regulations do not apply to the transporting of substances,
articles or objects that are reasonably believed to contain organisms
that are infectious to humans or to animals if the substances,
articles or objects are
(a) enclosed
in a waterproof form of containment;
(b) transported on land in a vehicle, other than a public passenger
road vehicle or a railway vehicle, from the place where they
are found as directly as possible to a veterinary or medical
doctor or a municipal, provincial or federal government office;
and
(c) constantly in the custody and control of the person in charge
of that vehicle.
2.6
Parts IV to IX do not apply to the handling, offering for
transport or transporting of a domestic consignment or transborder
consignment of dangerous goods that are
(a) alcoholic
beverages that
(i) have
a flash-point greater than 23°C,
(ii) contain not more than 70 per cent alcohol by volume,
and
(iii) are contained in an inner receptacle or in an inner
packaging that has a water capacity not greater than 5 L,
if the consignment
is accompanied by a shipping document that sets out the name
of the dangerous goods and the dangerous goods are contained
in packagings that are marked in accordance with the Excise
Act or in accordance with provincial regulations respecting
bonded commodities; or
(b) solutions
of water-miscible alcohol that
(i) have
a flash-point greater than 23°C, and
(ii) have a volume
(A)
not more than 50 per cent of which consists of a water-miscible
alcohol that has a flash-point less than 37.8°C, and
(B) at least 50 per cent of which consists of a substance
that is not dangerous goods,
if the consignment
is accompanied by a shipping document that sets out the name
of the dangerous goods and the dangerous goods are contained
in packagings that are marked with the words "Alcohol exempt"
or "Exempt d'alcool"."[SOR / 91-711]
2.7.1
Parts IV to VII, sections 9.2 to 9.12 and Part XII do not
apply to the handling, offering for transport or transporting
of limited quantities of dangerous goods where the dangerous goods
are transported by any means of transport, other than aircraft,
if SOR / 91-711
(a) the
inner packagings meet the standards for inner packagings set
out in Schedule VIII;
(b) the outer packagings meet the standards for outer packagings
set out in Schedule VIII and are marked with
(i) the
shipping name of the dangerous goods,
(ii) the words "limited quantity" or "quantité
limitée" or the abbreviations "ltd. qty."
or "quant. ltée", and
(iii) in the case of dangerous goods included in Class 3,
the flash point or the flash point range for the division
of the flammable liquids in the outer packagings, in accordance
with section 3.13; SOR / 93-525
(c) the
consignment is accompanied by a shipping document that is in
accordance with Part IV or that
(i) contains
the following information:
(A)
the shipping name of the dangerous goods,
(B) the words "limited quantity" or "quantité
limitée" or the abbreviations "ltd. qty."
or "quant. ltée",
(C) the primary classification and the subsidiary classification
of the dangerous goods,
(D) the product identification number of the dangerous
goods, and SOR / 93-525
(E) the total quantity of the dangerous goods covered by
the shipping name,
(ii) accompanies
the consignment in accordance with sections 4.23 to 4.26,
and
(iii) is retained for a period of two years in accordance
with section 4.27; and
(d) the
package is labelled,
(i) in
the case of dangerous goods that are a liquid, with the label
set out as Figure 3 in Part IV of Schedule V, and
(ii) in the case of dangerous goods that have a primary or
subsidiary classification of Division 1 of Class 6, with the
label set out as Figure 14 in Part I of Schedule V.
Exemptions in Relation to Road
2.20
(1) Subject to subsection (2), these Regulations, except for section
7.32, do not apply to the handling, offering for transport or
transporting of dangerous goods where the dangerous goods
(a) are
transported by a road vehicle that is a recreational-type vehicle;
and
(b) are necessary for the operation of the vehicle or for recreational
purposes. [SOR / 91-711]
(2) Where
the recreational type vehicle referred to in subsection (1) is
to be transported on a Ro-Ro, at the time the driver of the recreational
type vehicle pays for the transportation of the recreational type
vehicle on the Ro-Ro, he shall notify the master of the Ro-Ro
or his agent of the presence of dangerous goods in the recreational
type vehicle.
2.21
(1) Subject to subsection (2), these Regulations do not apply
to the handling, offering for transport or transporting of dangerous
goods by road between a retail outlet and the residence of the
purchaser or the place of consumption if the dangerous goods are
not sent through the postal system and
(a) are
contained in a packaging or small container designed to contain
them; or
(b) (revoked)
(2) Subsection
(1) does not apply to dangerous goods that are
(a) explosives,
other than safety explosives;
(b) flammable gases in a cylinder that has a water capacity
greater than 45 L;
(c) poisonous gases;
(d) corrosive gases; or
(e) radioactive materials.
2.31
Part IV, sections 5.16 to 5.33 and Part IX, except sections 9.10,
9.13 and 9.14, do not apply to the transporting solely by road
of
(a) gasoline
or fuel oil, including diesel, if
(i) the
gasoline or fuel oil is transported in one or more containers,
(ii) each container is transported in an open vehicle so that
the label or placard displayed on the container is visible
from outside the vehicle,
(iii) each container is secured to the vehicle during transport,
and
(iv) the total capacity of containers in or on the vehicle,
excluding the volume of the gasoline used for the propulsion
of the vehicle, is not more than 2 000 L;
(b) propane,
acetylene, oxygen or mixtures of methyl acetylene and propadiene
if
(i) the
dangerous goods are
(A)
in a total quantity not greater than 500 kg gross mass,
or
(B) contained in not more than 5 cylinders,
(ii) the
container or the cylinder that contains the dangerous goods
is transported in an open vehicle so that the label displayed
on the container or the cylinder is visible from outside the
vehicle, and
(iii) the container or the cylinder is secured in or on the
vehicle during transport; and
(c) herbicides,
solutions of herbicides, pesticides or solutions of pesticides
if
(i) the
product or solution is transported in a tank that has a total
volume of 5,000 L or less,
(ii) the tank is being used for the mixing or holding of the
product or solution, prior to or during application procedures,
and
(iii) the tank is placarded in accordance with Part V but
without the product identification number
